Vehicle Hire Terms

Contract/Agreement: The contract is between Australia 4 Wheel Drive Rentals an Australia company incorporating the web site www.australia4wheeldriverentals.com - either operator or agent - and any person (client) travelling or intending to travel on an itinerary or tour supplied. This agreement shall be interpreted in accordance with the law of Northern Territory in the Commonwealth of Australia. The actions, claims, demands or suits arising out of this agreement shall be exclusively justiciable in the courts of the said state. Australia 4 Wheel Drive Rentals has the sole authority to vary or omit any of these terms.

Quotations: All quotations are subject to availability of services quoted and are not guaranteed until the deposit is received and booking confirmed. Some quotations will have validity dates on them and if a deposit is not received by that expiry date then the quotation will automatically cancel without notification to you.

Bookings: To secure a booking, Australia 4 Wheel Drive Rentals requires a completed Booking Form by the client, or the parent/legal guardian (if the client is under 18 years) and payment details (credit card number, expiry date, name on card). A booking is valid from the date Australia 4 Wheel Drive Rentals confirms acceptance in writing and when Australia 4 Wheel Drive Rentals receives the client's returned confirmation section of the ticket signed by the client. Australia 4 Wheel Drive Rentals reserves the right to decline any booking at their discretion.

Deposits: A deposit will be required to confirm any booking. Deposit conditions for certain products may vary and we will advise you in writing of these conditions at the time of quotation.

Final Payment: Final payment may be due 35 days (except Britz Vehicles at 65 days) prior to travel date or paid at pickup depending on which is requested in your quote. If full payment is requested 35 days (except Britz Vehicles at 65 days) prior to travel date then NO vouchers will be issued until final payment is received. Final payment conditions for certain products may vary and we will advise you in writing of these conditions at the time of quotation. In the case of non-payment of the balance by the due date, Australia 4 Wheel Drive Rentals will treat the booking as cancelled unless the client communicates to the contrary. Some operators will request the balance of payment prior to travel. This will be advised of this in your quote by Australia 4 Wheel Drive Rentals.

Prices: All prices will be quoted in Australian Dollars. Please use a currency converter to check the cost. All prices include Australia Goods and Services Tax of 10% and New Zealand Goods and Services Tax of 12.5%.

Cancellations: Must be in writing and can either be per email, facsimile, or by letter. No cancellation will be accepted unless received in writing, signed by the hirer and received by us directly from you. The date that we receive the cancellation notice is the date that it is deemed cancelled. A minimum cancellation fee of AUD$19.00 will be charged by Australia 4 Wheel Drive Rentals to cover administration costs . Cancellation conditions for certain products may vary. Deposits paid at booking are non-refundable.

Cancellation Fees:
Each suppler varies in their terms and conditions. We supply you the client with the correct terms of the supplier when we quote your enquiry or ticket your booking based on the relevant suppllier. It is part of the booking requirements that you read, understand and accept the suppliers terms and conditions.

Australia 4 Wheel Drive Rentals $100.00 cancellation administration fee will apply to all cancellations. There is no refund for early return of vehicle for any reason whatsoever.

Refunds will not be made for bookings cancelled due to inclement weather. We strongly recommend that you take out travel insurance, including cancellation insurance and effects of Force Majeure!

Here are the following Major Suppliers Cancellation fees

MAUI - Cancellation Fees:
If cancelled 21 days prior to pick up - No Fee
If cancelled 21 to 7 days prior to pick up - 20% of Gross Rental
If cancelled 6 to 1 days prior to pick up - 50% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
If vehicle is returned early for any reason whatsoever - No Refund Available
There is no refund for late pick up or early return of vehicle

BACKPACKER.Cancellation.Fees
If cancelled 25 days prior to pick up - No Fee
If cancelled 24 to 6 days prior to pick up - 15% of Gross Rental
If cancelled 5 days prior to pick up - 40% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
If vehicle is returned early for any reason whatsoever - No Refund Available
There is no refund for late pick up or early return of vehicle.

BRITZ Cancellation Fees
If cancelled up to 60 days prior to pick-up No Fee
If cancelled from 60 to 30 days prior to pick-up 20% of Gross Rental
If cancelled 29 to 7 days prior to pick-up 50% of Gross Rental
If cancelled within 6 days prior to pick up or No-Show 100% of Gross Rental
If vehicle is returned early for any reason whatsoever No refund available
BRITZ AMENDMENT FEE
An amendment fee of AU$50 per amendment is charged when a change to an existing booking is made. This applies but is not limited to changing the vehicle type, reducing the number of rental days, changing pick-up dates or changing the pick-up or drop-off location made 14 days or less before pick-up. Where the number of rental days is being extended, the amendment fee will not apply.

APOLLO Cancellation Fees
If cancelled 25 days prior to pick up - No Fee
If cancelled 7 to 24 days prior to pick up - 20% of Gross Rental (minimum $250)
If cancelled less than 7 days prior to pick up - 50% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
There is no refund for late pick up or early return of vehicle.

TRAILMASTER
Cancellation Fees If cancelled 25 days prior to pick-up No fee
If cancelled from 24 to 7 days prior to pick-up 15% of gross rental
If cancelled 6 days or less prior to departure 40% of gross rental
Or a No show 80% of gross rental If vehicle is returned early for any reason whatsoever, no refund available.
In the event of ANY cancellation, the deposit will not be refunded.

KEA Cancellation Fees
Fees in Percentage of Gross Rates if: 25 days before pick-up = No fee
24 days to 6 days before pick-up = 15%
5 days to 0 days and no show = 50%
If vehicle is returned early = No Refund available

AROUND AUSTRALIA MOTORHOMES Cancellation fees
Other than for exceptional circumstances and then entirely at the discretion of the manager, the following fees will apply for cancellations after confirmation of booking (payment of deposit):
A $75.00 cancellation administration fee will apply to all cancellations.
Within 30 days prior to pick-up: $500.00
Within 7 days prior to pick-up: 50% of rental cost
If cancelled on day of pick-up or a No Show:
No refund available If vehicle is returned early: No refund available

4WD Hire (Brisbane) Cancellation Fees
The following fees will apply to cancellations.
If cancelled 25 days prior to vehicle collection: No Fee
If cancelled 24 - 7 days prior to vehicle collection: 15%
If cancelled 6 days prior to vehicle collection: 50%
If cancelled less than 6 days: 100% and/or at the discretion of Four Wheel Drive Hire Service

Problems: In the event that a client has a complaint about any of the travel arrangements, they must advise the relevant supplier at the time and inform Australia 4 Wheel Drive Rentals in writing. This will assist settlement of any grievance or complaint. Any disputes over the quality, fitness and condition of the product is between the client and the product supplier and as such, Australia 4 Wheel Drive Rentals cannot be held liable for any problem with the product supplied or not supplied.

Australia 4 Wheel Drive Rentals accepts no liability for personal injuries and losses.

It is the client's responsibility to choose a trip within their capabilities.

Add to our Terms and Conditions: Prior to making a reservation please also read the Terms and Conditions that relate to the rental vehicle. There is a link to the relevant Terms and Conditions in the quote forwarded to you.

Reservation requests are only accepted on the condition that this User Agreement, and the Terms and Conditions that apply to the relevant rental vehicle have been read and understood, and that you AGREE TO ACCEPT THEM.

A reservation deposit is required to make a reservation. All requests for reservations are subject to availability. Once availability has been established and the reservation confirmed then the deposit becomes non-refundable.

Consideration may be given to credit the non-refundable deposit towards a future booking (subject to sole discretion of Management). The deposit can only be applied to the deposit portion of the rental and not to the balance payable to the rental company.

We strongly recommend that full travel insurance and including cancellation insurance be obtained. Unforeseen circumstances that may require you to cancel travel plans can be very costly. In most cases this will incur a heavy penalty including total loss of the hire costs paid by you.Please ensure you have adequate travel insurance cover.

You must read the Terms and Conditions that apply to the vehicle you wish to hire prior to making a reservation request. Any cancellation fees that apply are additional to the forfeiture of the reservation deposit amount.

When calculating the cancellation fees the calculations will be based on the full listed retail rate of the supplying rental company and not on any discounted rates.

This site is provided by Australia 4 Wheel Drive Rentals www.australia4wheeldriverentals.com and it's websites for the purpose of providing travel information and bookings with selected travel agents and tour operators. By booking or purchasing any service offered on this site an agreement arises between www.australia4wheeldriverentals.com and it's websites(us) and the customer(you).

If you do attempt to hold us liable for the results of your actions then you specifically acknowledge that all disputes will be defended in Northern Territory, Australia subject to Australian Laws.

Other Conditions: Australia 4 Wheel Drive Rentals, it's directors or employees as operator or agent finalises all arrangements for these products on the express condition that it shall not be held liable for any injury, loss, accident, delay or irregularity which may be occasioned either by reason of any defect in any vehicle, vehicle delay, vessel or equipment or by Acts of God or through the acts of default of any company or person engaged in conveying the passengers or in carrying out our arrangements of the tours or otherwise in connection herewith. Australia 4 Wheel Drive Rentals reserves the right to change any of the facilities, services or prices described in the information provided.

Australia 4 Wheel Drive Rentals accepts no liability for any action or activity undertaken by the client arranged independently or Australia 4 Wheel Drive Rentals while on holiday. Australia 4 Wheel Drive Rentals shall not be liable to compensate clients for associated expenses incurred as a result of their booking. No refund will be made for any unused services that are included in the price.

We reserve the right to levy any government increase in local taxes that may be introduced after the publication of this site, however, we will make every effort to ensure that you are notified of any of these matters either prior to your booking or as soon as practicable after we have knowledge of such increases.

Rates and Conditions quoted in our brochures and/or documentation are subject to change without notice.

Please note that the car, campervan and motorhome rental companies reserve the right at their sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions.
