The following Terms and Conditions must be read in conjuntion with the (Click Here) Australia 4 Wheel Drive Rentals Conditions and Terms.

Booking and reservations requests are only accepted Australia 4 Wheel Drive Rentals on the basis that those Conditions and Terms for the specified vehicle supplier have been throughly read and understood and agreed too.

SUMMARY OF THE RENTAL RATES & CONDITIONS
Season: 1st April 2010 to 31st March 2011

Part A of the Rental Agreement Includes

Acceptance of Loss/Damage Liability

The Hirer acknowledges a liability of AUD$5500 for any damage to the vehicle regardless of fault. The hirer is responsible for the vehicle until the Owner accepts custody.

-----EXEMPT EVENTS-----

Under the terms and conditions of this agreement the hirer is liable for
- all overhead and underbody damage
- damage to tyres or windscreens
- loss or damage arising from where the vehicle (or the keys) have not been kept secure.
- loss or damage where the vehicle is partially or totally immersed in water regardless of cause
- Damage to a vehicle where the coolant, oil or other levels have not been checked or maintained by the hirer.

 

Part B of the Rental Agreement Includes

TERMS AND CONDITIONS Owner and Renter

This document is an AGREEMENT between vehicle rentor supplier (full details provided upon booking) (hereinafter called "The Owner";) and the party whose signature appears as renter on the front of the document (hereinafter called "The Renter";) whereby it is mutually agreed between the parties as follows:

  1. The owner hires to he Renter and the Renter rents from the Owner the motor vehicle that is described on the front of the document (hereinafter called "The Vehicle";) for the rental period and at the rental amount set out on the front of the document and subject to the following terms and conditions.

  2. Any person who signs this Agreement on behalf of the Renter warrants that for all purposes of the Agreement they are the duly authorised agent of the Renter and if such person is not the duly authorised agent of the Renter, then in consideration of the Owner permitting that person to drive the vehicle they shall be deemed to be the Renter and agree to be be bound by all of the terms and conditions of this Agreement.

  3. The renter warrants that: a) no person shall drive the vehicle that: i) does not have a current driver’s license valid in the state or territory and valid for the class

of vehicle hired ii) has been refused motor vehicle insurance iii) is under the influence of liquor or drugs iv) is under the age of 21 years v) has not held drivers license for the required class of vehicle for a minimum of 12 months

b) all particular shown on the front of this document relating to the driver and the Renter are correct c) the Renter acknowledges that the Owner enters into this Agreement strictly on the reliance on the truth of the above representations and those on the front of the document

4. The expression "the Renter";shall mean and include: a) any person who signs this Agreement whether on their own behalf or on behalf of any other person, company, corporation or government department b) the person, company, corporation or government department shown in the "INVOICE TO"; selection on the front of the document

c) any person, company, corporation or government department which is or becomes vicariously liable at law to third parties for loss or damage caused b the driver of the vehicle where is established tat the hiring was made by the driver as agent for an on behalf of such person, company, corporation or government department

d) in the case of joint hirers that the Renters shall jointly and severally liable in respect of all the provisions of the Agreement.

Rental Period and Rental Charges

  1. The rental day is for the 24 hour period that is allowed by the Owner (eg Commercials 7am to 7am) and late changes will apply if vehicle are not returned on time. The rental period shall be from the date and time out on the front of this document until the vehicle is returned to the depot from where it was hired

  2. After a one hour period of grace, later return charges will be calculated at one third of the daily rental rate for each hour or part thereof to a maximum of three hours after which normal daily rate will apply

  3. The Renter shall pay the total rent for the rental period to the Owner and that rent shall be the total of: -a) the "daily rate"; which may be the rates as per the Owner’s brochure, an agreed flat rate or any

other rate accepted by the Renter, which may include a charge for kilometers driven in excess of the agreed minimum (the total distance driven shall be measured by the starting and finishing readings on the odometer in the vehicle which must not be tampered with)

b) charges for fuel, insurance waivers, repositioning, cleaning and any other charges c) any late return charges that may be applicable d) all stamp duties payable in respect of the rental period e) all other government taxes including GST f) a sum equal to the value of any tools or accessories lost or stolen during the rental period g) the agreed sum payable in respect of each and every damages excess as specified on the front

of the document h) any fines for traffic or parking offenses incurred during the rental period plus administration fees, where applicable i) any expenses incurred by the Owner is repossessing the vehicle

4. The Renter hereby irrevocably any unconditionally authorises the Owner to charge from time to time, any credit or charge card nominated by the Renter for that purpose with all charges referred to above and in the event that such charges are not met by the credit provider within 7 days such charges being claimed by the owner then the Renter shall pay some to the Owner on demand.The Renter shall be personally liable for all charges under the rental Agreement if the person or entity to whom the charges are forwarded, at the direction of the Renter, fails to pay such charges.

Responsibilities of the Renter

  1. The Renter shall take good care of the vehicle at all times and maintain the correct coolant, oil and other fluid levels for all components and keep tyres correctly inflated

  2. The Renter must not let any person that is not authorised by this Agreement drive the vehicle

  3. The vehicle must not be used by the Renter for any illegal purpose, or to race, or for any other purpose that may damage the vehicle, or to carry or tow any load in excess of what the vehicle was designed to carry

  4. The vehicle must not be driven or used by the Renter in contravention of any of the provisions of the road traffic act of the State or Territory in which it is driven

  5. The vehicle must not be driven by the Renter while they have a blood alcohol level that is equal to or greater than the percentage which constitutes an offense at law

  6. The vehicle must be driven or used by the Renter, or anybody else, for the conveyance of passengers for hire, fare or reward

  7. The Renter will not, without the written consent of the Owner, make any admission of liability or promise of compensation in the event of any property or third party damage as the result of an accident

  8. The vehicle will not be used for the transportation of restricted article of property unless the Renter, at their own cost, obtains all necessary permits and licenses

  9. The vehicle will not be used by the Renter to haul any goods unless specified on the face of this Agreement or to convey any load that is improperly loaded or secured

  10. The vehicle will not be abused or misused by the Renter in any way or be driven or used when it is in a damaged or unsafe condition

  1. The vehicle will not, without the prior written consent of the Owner, be used by the Renter for the carriage of inflammable liquids, gases or solids or any goods, materials or substances of an explosive or corrosive nature

  2. The Renter will report in writing to the Owner within 24 hours after any theft or breakdown of the vehicle or the occurrence of any accident or incident which might give rise to any claim against the Owner or the Renter by a third part for injuries or damages to property arising out of the use of possessions o the vehicle by the Renter

  3. The Renter will enable the Owner to inspect th vehicle for the purpose of ascertaining its condition and state of repair

  4. Th Renter acknowledges that the vehicle (which expression shall include all tyres, tools, accessories and equipment) is the property of the Owner and that is has been received by the Renter is good order and condition and the Renter covenants with the Owner that at the end of the rental period the vehicle will be in the same condition as at the beginning of the hire, except for fair wear and tear (as determined by the Owner) and any accident damage that may be the subject of the conditions of this Agreement and that the Renter will indemnify the Owner for all losses and expenses in respect of any damage to the vehicle

  5. The Renter covenants with the Owner that the Renter will comply with all State and Federal statues relating to the operation of motor vehicles and, without limiting the generality thereof, will pay all taxes, tolls, levies, charges, duties, fines and penalties imposed on the vehicle or arising from the use of vehicle by the Renter during the rental period and will apply for and obtain all necessary permits and licenses, lodge returns, execute such documents and do all the acts and things and pay all such monies that may result from a particular use of the vehicle and will indemnify the Owner in respect of any liability incurred for any type of breach

 

Damage to the Vehicle

The Renter agrees that:

  1. The Renters shall be liable to the Owner for the full amount of any damage to the vehicle (however it may have been caused) which occurs on or after any breach by the Renter of any term, condition, warranty or undertaking contained in this agreement

  2. The Renter acknowledges and agrees that the value of any damage to the vehicle shall be assessed by the Owner. The Owner inspects the vehicle at the beginning and end of each hire of the vehicle and any new damage that appears on that appears on that report shall be conclusive evidence that the damage was done by the most recent Renter and therefore that Renter shall be liable for the cost of repairing those damages. (It is recommended that the renter inspects the vehicle prior to departure)

  3. The Renter shall be liable to pay the Owner on demand for the value of any damage or loss assessed as having been cause by that Renter. The term is not restricted to damage to the vehicle or other property but may include the loss of rental income while the vehicle is unavailable for hire

  4. The amount payable by the Renter for damages may be limited to the amount of the excess stated on the face of the rental Agreement notwithstanding that clause 5 below will still apply in the event of off-road use, as will all other relevant terms and conditions

  5. If the renter uses the vehicle in any area where unmade or unsealed roads are common then the Renter shall be liable for and indemnifies the owner against: a) the cost of rectifying all tyre damage not attributable to normal wear and tear b) the cost of rectifying all under carriage damage c) the cost of repairing all body damage unless such damage can be proven to relate to a specific accident on a public road d) the cost of returning the vehicle to the originating branch should be vehicle for any reason break down, be abandoned or need towing e) the cost of rectification of damage to suspension, chassis, differential, gearbox, transfer case, axles, wheels, engine or other damage cause by abnormal use, misuse or abuse of the vehicle f) the cost of replacing spare wheels and any other tools, equipment or accessories

Repossession

The Owner may determine this Agreement and without notice repossess the vehicle whereupon all monies previously paid by the Renter shall be forfeited to the Owner but without prejudice to any claims or rights of the Owner is any of the following events: -1) the Renter is found to be in breach of any term, condition or warranty contained in this Agreement

or has been made any misrepresentations to the Owner 2) the Owner considers on reasonable grounds that the conduct of the renter is likely to affect prejudicially the interest of the Owner or the condition of the vehicle 3) the renter is in arrears of rent or other monies due to the Owner

No Claim Against the Owner

1) The renter will not at any time make any claim against the Owner for any loss or damage or delays through breakdown, mechanical difficulty, fire or accident or by reason of the vehicle being found to be unfit for the purpose of the Renter or with respect to any loss or damage to any property stolen from the vehicle or damages or otherwise during the rental period or left in the vehicle after the return of the vehicle to the Owner and the Renter hereby agrees to indemnify the Owner in respect of all claims, damages and actions brought against the owner in respect thereof

2) The fact that all the Owner's vehicles are comprehensively insured against theft, fire and accident damage in no way diminishes the responsibility of the Renter to pay for any damage cause (or the agrees excess, subject to the terms nd conditions)

3) The Renter is not and shall not deemed to be the agent of the Owner for any purpose whatsoever and for all purposes shall be in no better position tan a person driving the vehicle with the consent of the Owner

4) Where the Renter prefers to arrange their own insurance cover, no liability will be accepted by the Owner. In the event of damage the vehicle will be returned to the Owner for assessment and repairs will be carried out by the Owner at the Renter’s expense

Warranties Excluded

Except for any warranties implied in this Agreement by the Trade Practices Act 1974, all conditions and warranties (statutory or otherwise) whether of fitness for purpose, quality or description are negative and excluded.

To the extent permitted by law, any warranties as to the condition of the vehicle are expressly excluded by the Owner and the Owner hereby limits their liability for breach of any condition or warranty implied by law to be replacement, repair or resupply and the Owner shall not be liable for any indirect or consequential loss or damage.

SUPPLIER'S CONDITIONS AND TERMS EXTRA NOTES:
• This document contains a summary of some of the rental conditions. For detailed conditions, refer to the rental agreement upon vehicle collection.
• Vehicle rates and the supplier quoted in this document are Gross, inclusive of Goods and Services Tax (GST) and are in Australian dollars. Please STRONGLY not the suppliers works on a rate where you add GST and not included. We the agent will in our quoting and Eticketing refer to Gross Agents rates with GST included.
• Rental basis is per 24 cycle day for the 4WD car.
• Minimum rental period is 1 day with the exception of one-way hires, which are subject to a 10-day minimum hire requirement.
• Minimum rental periods are subject to change during peak periods.
• These rates and terms may not apply to convoy bookings (any rental that consists of five or more vehicles travelling together). The suppkierhas a dedicated convoy department and requests for convoy quotes/bookings should be directed first to Reservations.
• These rates and terms may not apply to rentals exceeding 100 days, which includes multihires. Requests for quotes/bookings of more than 100 days should be directed first to Reservations.
• All rates and conditions are subject to change as required and without prior notification.

• All bonds are taken in full off hirers visa or mastercard valid credit card only. No other form of payment accepted.

The Security Deposit Is Fully Refundable Provided:
• Note: The security deposit is fully refundable provided the vehicle is returned on time, to the correct location, undamaged, with a clean interior and with full fuel tanks (fuel being petrol or diesel) and gas bottle.
• Note: FOR SECURITY PURPOSES, ONLY THE HIRERS CREDIT CARD CAN BE USED FOR VEHICLE SECURITY DEPOSITS

CREDIT CARDS
• Note: The credit card holder will be jointly and severally liable as a customer. Accepted credit cards are Visa Card, MasterCard and American Express. A non-refundable 2% administration fee will apply to all Visa and MasterCard transactions or 4.5% for American Express. Credit card administration fees also apply to debited security bonds and only the hirer’s credit card is acceptable to use for the purpose of the security bond.

CALCULATION ERRORS
• Note: The supplier and/or their agent Australia 4 Wheel Drive Rentals/Goholi Pty Ltd will not honour calculation errors. Should a calculation error occur the supplier will charge for the shortfall. This also applies to the Quote or ETicket.

AGENT NON-PAYMENT
• Note: In the case where pre-payment is required and this has not been made the hirer agrees to pay the full costs to the supplier.

LICENCE
• Note: A current and full motor vehicle driver’s licence is required and must be produced upon vehicle collection.
• Note: You must be at least 21 years of age to rent any of our vehicles.
• Note: Should a foreign licence be in a language other than English it must be accompanied by a current international driving permit issued in the same country as the • • Note: To be brought wby the hire to picup of the rental: Agent Eticket, driver’s licence was issued. An accredited English translation will be accepted in lieu of an international driving permit.
• Note:You will need to provide a valid, current drivers licence including any additional drivers who may wish to drive during the hire. If you are hiring one of our larger vehicles, your licence(s) must be valid for the class for the vehicle you are renting. And of course you'll need to bring your pre arranged method of payment.

AGE RESTRICTIONS
• Note: Drivers must be 21 years of age or over. For drivers 75 years of age or over, a medical certificate stating that the customer is fit to drive for the duration of the hire is required upon vehicle collection.

ADDITIONAL PRODUCTS & SERVICES
• Note: There are no optional extra's available with this hire.
• Note: The vehicle comes with only one spare tyre

ROAD RESTRICTIONS
• 4WD cars can also be driven on gazetted unsealed roads.
• 4WD vehicles routes to be taken must be submitted to the agent who will send it to the supplier at quotation for booking notations.
• 4WD vehicles may only travel to the following areas with the written permission of
>>> Simpson Desert, Strzelecki Track, Gunbarrel Highway, Cape York, the Bungle Bungles, Oodnadatta Track, Birdsville Track, Tanami Track, the Plenty Highway, Gibb River Road, Burke Development Road from Chillagoe to Normanton and Savannah Way from Normanton to Borroloola, Fraser Island, Finke Road (between Alice Springs and Oodnadatta), Central Arnhem Road and Arnhem Land in general.
• Vehicles are NOT permitted to travel on the Canning Stock Route, the Lost City in Litchfield Park, the Telegraph section of the road to Cape York, Boggy Hole (Finke Gorge National Park) and the Old South Road from Maryvale to Finke, at any time.
• Vehicles are NOT permitted to travel to Cape York between the months of December to May. At all other times permission is required.

Written permission is standard with most suppliers and they have to protect their clients (Hirer's) and vehicles from going out when roads are closed, flooded, under fire – etc all natural disaster mode. So the depot the hirer is picking the vehicle up from usually wait for the day of pickup and check the weather, any weather pending warnings, closed roads alerts, Head Office alerts, road conditions, local area condition and local authorities and then make a decision. The reason is road conditions and weather conditions can change. The client must receive this permission off the branch who will determine if the roads are suitable when the hirer picks up their hire vehicle. Also it is to be noted all the suppliers vehicle have 1 (One) spare tyre only and it is up to the client to check they fully understand when being shown thru the vehicle at pickup how to change a tyre and it's the client's responsibility to be aware of where one can get the spare mended whilst on travel.
• The supplier reserves the right at its sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions, and the distance to nominated destinations in relation to the length of the hire period.

CHANGE OF DROP-OFF DESTINATION
• If the customer wishes to change the drop-off destination, they must first obtain authorisation from the Reservations or Scheduling departments.
• Subject to the change being approved, additional charges will apply.

CAN I RETURN THE VEHICLE AFTER HOURS
• Most certainly. Our yard has a combination lock on the gate and an after hours key drop, enquire when you pick up the vehicle.

BOOKING AMENDMENTS
• All amendments to bookings are subject to availability of vehicle and/or package.

ONE-WAY RENTALS
• One-way rentals are available on request.
• Minimum rental period for one-way hires is required

TRANSFERS
• Clients will need to make their own way to and from the suppliers depot/branch, at their own expense. The branch is on the Stuart Hwy Darwinaround15klm from the airport.

INFRINGEMENTS AND ADMINISTRATION FEES
•
The supplier reserves the right to charge the hirer for any speeding, toll way or parking fines and/or vehicle damage including Third Party property damage not reported on return of the vehicle. In addition to these costs, the supplier reserves the right to charge for associated administration costs for processing the fines (irrespective of excess) and/or all insurance claims in the event of the customer not having a NIL excess. In addition to the costs associated per fine and/or insurance claim, an administration fee may be applicable.

CUSTOMER CARE ON-ROAD ASSISTANCE
• Any problems associated with the vehicle, including equipment failure, must be reported to the supplier as soon as possible and within 24 hours in order to give the supplier the opportunity to rectify the problem during the rental. Failure to do so will compromise any claims for compensation. The supplier do not accept liability for any claims submitted after this period. Any problems associated with the vehicle, including equipment failure, must be reported to the suppliers telephone number given at pickup of the hire vehicle.

CHANGE OF VEHICLE
• Should the vehicle booked be unavailable through unforeseen circumstances, the supplier reserve the right to substitute an alternative vehicle without prior notification and at no extra cost.
• This shall not constitute a breach of contract and does not entitle the hirer to a refund.

VEHICLE CATEGORY
• Vehicles cannot be requested by make or model, only by vehicle category.

VOLUNTARY DOWNGRADE
• Should the hirer decide to take a lesser vehicle than booked they will not be entitled to any refund.

CANCELLATION POLICY
• The reservation deposit is strictly non-refundable.  
• If cancelled to 1 days prior to pick-up, onday of pick up or No-Show a cancellation fee of 100% will apply.
• AGENTS NOTES: We STRONGLY recommend that all renters acquire suitable travel insurance - including all variations of clauses for cancellation, travel delay's, medical, loss of property, insurance.

IMPORTANT
• The supplier reserves the right to refuse any rental at its discretion.

ANIMALS
• No animals are permitted in our vehicles, excluding guide dogs.

Open Saturdays and Sundays from 7am - 9am only
• Our office opens at 7am daily until 5 pm weekdays and 7am until 9 am weekends. The rental hours start from 7am until 7am the following morning however you may return the vehicle after hours if you wish by using our after hours key return located at the front door of our office.

OPENING HOURS- PICKUP AND DROPOFF
• Our rental hours are strictly 7am until 7am however if the vehicle is available after 12pm the day prior to your booking you are more than welcome to pick it up in the afternoon for no extra charge.

LIMIT OF LIABILITY
• In the event of no alternative vehicle being available to the renter our liability is limited to a refund of the hire charge or in the case of mechanical failure (unless caused by the renter) the remainder of the hire period.

DOES THE SUPPLIER HAVE ANY OTHER CHARGES
• We supply vehicles with full fuel tank(s) so there are refuelling costs if the vehicle is not returned full. There may also be excess km charges if you go over your free daily km allowance. We also charge for any accessories that you may wish to hire, all which will be explained when you contact the office to make an enquiry about renting one of our vehicles.

DISCLAIMER
